1. 1. Acceptance of Terms

By accessing or using the MyAuPair platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the platform.

You must be at least 18 years old to create an account. By registering, you confirm that you meet this age requirement and that all information you provide is accurate and complete.

2. 2. Service Description

MyAuPair is an online platform that facilitates connections between host families and au pairs through AI-powered compatibility scoring, real-time translation, and structured profiles. The platform operates in France and Germany.

MyAuPair does not act as an employer, employment agency, or intermediary. We provide tools to help users find compatible placements, but the contractual relationship between a family and an au pair is solely between those parties. MyAuPair does not guarantee that any user will find a suitable placement.

3. 3. User Accounts & Eligibility

To use MyAuPair, you must:

• Be at least 18 years of age
• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Promptly update your information if it changes

You are responsible for all activity that occurs under your account. If you suspect unauthorized access, you must notify us immediately at contact@myaupair.com.

4. 4. User Roles

MyAuPair supports three user roles:

• Family: Host families searching for au pairs. Families may access limited features for free or subscribe to Premium for full access.
• Au Pair: Au pairs searching for host families. Au pairs access all platform features at no cost.
• Admin: Platform administrators. This role is reserved for MyAuPair staff.

You may only register for one role per account. Misrepresenting your role is a violation of these terms.

5. 5. Subscription & Payments

Premium subscriptions are available for families at the prices displayed on our pricing page. All payments are processed securely by Stripe and charged in EUR.

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You can cancel your subscription at any time through your account settings or by contacting us.

Refund policy: Monthly subscriptions are non-refundable. For annual or multi-month subscriptions, a pro-rata refund may be issued for the unused portion if you cancel within the first 14 days. Refund requests should be sent to contact@myaupair.com.

6. 6. User Content & Conduct

You retain ownership of all content you submit to MyAuPair, including profile information, photos, messages, and reviews. By submitting content, you grant MyAuPair a non-exclusive, worldwide license to display, store, and process your content for the purpose of operating the platform.

You agree not to submit content that:

• Is false, misleading, or fraudulent
• Is discriminatory, harassing, or defamatory
• Violates any applicable law or regulation
• Contains personal contact information intended to circumvent the platform
• Infringes on the intellectual property rights of others

MyAuPair reserves the right to remove any content that violates these terms and to suspend or terminate accounts of repeat offenders. Content may be moderated by AI to detect violations.

7. 7. AI-Powered Features

MyAuPair uses artificial intelligence to:

• Analyze profile information and quiz responses to generate compatibility scores
• Suggest compatible profiles based on multiple dimensions
• Generate profile summaries from user-provided data
• Translate messages between supported languages
• Moderate content for policy violations

Important: AI-generated compatibility scores are advisory only. The AI suggests compatible profiles but never automatically rejects or excludes any candidate. All decisions about whom to contact or engage with remain entirely with the user.

You may withdraw your consent for AI processing at any time through your account settings. Withdrawing consent will disable compatibility scoring and AI-powered suggestions for your profile.

8. 8. Intellectual Property

The MyAuPair platform, including its design, code, algorithms, and branding, is the intellectual property of MyAuPair SAS. You may not copy, modify, distribute, or reverse-engineer any part of the platform.

User-generated content remains the property of the respective user. MyAuPair claims no ownership over user content beyond the license granted in Section 6.

Automated scraping, data collection, or systematic downloading of content from the platform is strictly prohibited.

9. 9. Limitation of Liability

MyAuPair is a platform that facilitates connections between host families and au pairs. We do not guarantee that you will find a suitable au pair or host family.

MyAuPair is not liable for:

• The accuracy of information provided by other users
• Interactions, agreements, or disputes between users outside the platform
• Any damages arising from the use or inability to use the platform
• Technical issues, service interruptions, or data loss beyond our reasonable control

To the maximum extent permitted by law, MyAuPair's total liability shall not exceed the amount you have paid to us in the 12 months preceding the claim.

10. 10. Termination

You may delete your account at any time through your account settings. Account deletion is permanent and results in the cascading deletion of all your data, including your profile, messages, reviews, and any associated records.

MyAuPair may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or use the platform in a manner that harms other users or the platform itself.

Termination for cause does not entitle you to a refund of any subscription fees.

11. 11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of France. MyAuPair SAS is a company registered in France.

Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.

Nothing in these terms limits your rights as a consumer under applicable EU consumer protection legislation, including the right to bring proceedings in your country of residence.
